1.                  Bill Number and Sponsor:

House Bill No. 4352

Senator Shackleton et al.

2.                  Purpose:

House Bill 4352 would amend Part 821, Snowmobiles, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, to prohibit the use of a red or blue lens cap on snowmobiles used anywhere in this State.

3.                  How Does This Legislation Impact Current Programs in the Department?

This Legislation would have very little impact on the current snowmobile program.

4.                  Introduced at Agency Request?

No.

5.                  Agency Support?

Yes.

6.                  Arguments Against the Bill:

None.

7.                  Arguments For the Bill:

Reportedly, some snowmobilers impersonate a police officer when they drive with a red or blue lens cap covering the headlights.  This may lead other snowmobilers to believe that they have committed a violation, or must not drive on a trail or through a particular parcel of land.  In addition, other snowmobilers have believed the red headlight cap to be a taillight or brake light.  This could contribute to collisions and other accidents.  State law requires at least one headlight and one taillight, unless the snowmobile is at least 25 years old, to help ensure that the driver can adequately see when driving.  Headlights that are red or blue, or any color other than white, may hinder a driver's view and place his or her safety at risk.

8.                  State Revenue/Budgetary Implications:

None.

9.                  Implications to Local Units of Government:

None.

10.              Administrative Rules Implications:

None.

11.              Other Pertinent Information:

None.

12.       User Groups/Customers that Support this Legislation (if known):

No user groups or customers supporting this legislation have been identified at this time.
